Terms of Service

By downloading, installing, or using Poor Mortal, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the app. Poor Mortal is operated by BUDGEFROWNIE LTD ("we", "us", or "our").

Poor Mortal is a playful daily-fortune app. You create a little character, share a date of birth and a few personality details, fill a daily vibe meter, optionally add friends and family, and receive daily fortune and compatibility cards. Content is generated for fun and is intended for entertainment purposes only.

Poor Mortal is a novelty entertainment app. Fortunes, horoscopes, compatibility readings, personality insights, and any other generated content are provided for entertainment purposes only. They are not professional advice of any kind and must not be relied upon for medical, legal, financial, relationship, psychological, or any other important decisions. Any actions you take based on content in the app are your sole responsibility.

Poor Mortal is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app on any device that you own or control, as permitted by the usage rules of the Apple App Store or Google Play Store (collectively, the "App Stores").

• You must be at least 13 years old to use Poor Mortal. The app is not directed to children under 13.
• You sign in with your Apple ID or Google account. There is no anonymous use.
• You must provide accurate information and are responsible for the security of your account.
• One account per person; do not share account credentials.
• You may delete your account and all associated data at any time from within the app settings.

Poor Mortal may offer optional in-app purchases and/or subscriptions that unlock additional features or content.

• All purchases are processed by the Apple App Store or Google Play Store and charged to your Apple ID or Google account. We never receive or store your payment card details.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple ID or Google Play account settings.
• Purchases are final and non-refundable except as required by applicable law or by the refund policies of the App Stores. To request a refund, contact Apple or Google directly — we cannot process App Store or Play Store refunds.
• We use RevenueCat to manage purchase records and entitlements across platforms.
• We may change pricing or available features at any time.

You may add information such as a date of birth, personality details, and friends and family for pairing. You retain ownership of content you provide. By using Poor Mortal you grant us a limited license to store and process that content solely to operate the app and generate your cards. You represent that you have the right to provide any content you submit and that it does not violate any law or third-party rights.

Poor Mortal uses artificial intelligence (via Google Gemini, called only from our servers) to generate fortunes, readings, and other text. You acknowledge that AI output is generated automatically, may be inaccurate or unexpected, is unique and non-reproducible, and is provided for entertainment only. We do not guarantee any particular result.

You agree not to:

• Submit offensive, unlawful, infringing, or non-consensual content, or details about other people that you have no right to provide.
• Harass, abuse, or harm other users.
• Attempt to exploit bugs, manipulate game systems, or abuse free features or promotions.
• Use automated tools, bots, scripts, or modified clients.
• Reverse engineer, decompile, or attempt to extract source code.
• Sell, trade, or transfer accounts or in-app items for real money.

We strive to keep Poor Mortal available but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, and we may impose limits on certain features to ensure fair usage.

We may suspend or terminate your account at any time for violation of these terms. Upon termination you lose access to your account and any unused entitlements. You may also delete your account at any time from within the app settings.

Poor Mortal is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure, or that generated content will be accurate or suitable for any purpose.

To the maximum extent permitted by law, BUDGEFROWNIE LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Poor Mortal, including loss of data or inability to access the service.

We may update these terms from time to time. We will notify users of material changes via the app or email. Continued use of Poor Mortal after changes constitutes acceptance of the updated terms.

These terms are governed by the laws of England and Wales. Any disputes shall be resolved through good-faith negotiation or, where necessary, the competent courts of England and Wales.

If you downloaded Poor Mortal from the Apple App Store or Google Play Store, the following additional terms apply:

• These Terms are between you and BUDGEFROWNIE LTD only, and not with Apple Inc., Google LLC, or any other app store provider.
• Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
• The app store provider has no obligation to provide maintenance or support services for Poor Mortal.
• The app store provider is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• In the event of any failure of the app to conform to any applicable warranty, you may notify the app store provider, and they may refund the purchase price (if any); to the maximum extent permitted by law, the app store provider has no other warranty obligation.
• The app store provider is not responsible for the investigation, defence, settlement, or discharge of any intellectual property infringement claim.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with all applicable third-party terms when using the app (e.g., your wireless data service agreement).
